1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the HoyaLift mobile application (“App,” “HoyaLift,” “Service”), provided by Abe’s Transportation, Inc. (“Company,” “we,” “us,” “our”) in connection with shuttle services operated for Georgetown University. By creating an account, logging in, or otherwise using HoyaLift, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility and Account Registration

HoyaLift requires you to log in using your Georgetown University credentials (NetID) or another account method we designate. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must provide accurate, current, and complete information during registration and keep that information up to date.

Access to HoyaLift may be limited to Georgetown University students, faculty, staff, and other authorized riders. We reserve the right to deny or revoke access to anyone who does not meet applicable eligibility requirements or who violates these Terms.

3. Description of Service

HoyaLift provides on-demand transportation service originating from Georgetown University’s Main Campus and Capitol Campus. Service is available within a 2.5-mile air radius of the Main Campus and a 2-mile air radius of the Capitol Campus as well as connecting the two campuses. Trips requested outside these service areas may not be available. Through the App, authorized users may request on-demand rides, track vehicle locations in real time, view estimated arrival times, and receive service alerts related to shuttle operations. The Service is provided to support transportation offered in connection with Georgetown University.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation;
• Attempt to gain unauthorized access to the App, other users’ accounts, or our systems;
• Interfere with or disrupt the App’s operation, servers, or networks;
• Reverse engineer, decompile, or attempt to extract source code from the App, except as permitted by law;
• Use automated means (bots, scrapers) to access the App without our prior written consent;
• Share your account credentials with others or use another person’s account without permission;
• Upload or transmit viruses, malware, or other harmful code;
• Misrepresent your identity or affiliation with Georgetown University.

5. Shuttle Service Disclaimer

HoyaLift provides real-time and scheduled information on a best-efforts basis. Actual shuttle arrival times, routes, and availability may vary due to traffic, weather, mechanical issues, or other factors outside our control.

The App is a tool to assist with trip planning and is not a guarantee of shuttle availability, timeliness, or route accuracy. Riders should exercise their own judgment regarding travel plans, especially for time-sensitive needs.

Physical shuttle operations are subject to separate safety rules and conduct policies communicated by Abe’s Transportation and/or Georgetown University, which remain in effect regardless of App use.

6. Location Data

HoyaLift collects and displays location data to provide real-time shuttle tracking and route features. By using the App, you consent to the collection and use of location data as described in our Privacy Statement.

7. Intellectual Property

The App, including its design, graphics, logos, and underlying software, is owned by or licensed to Abe’s Transportation, Inc. and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. All other rights are reserved.

8. Third-Party Services

HoyaLift may incorporate or link to third-party services (e.g., mapping providers). We are not responsible for the content, accuracy, or practices of third-party services, which are governed by their own terms.

9. Suspension and Termination

We may suspend or terminate your access to HoyaLift at any time, with or without notice, for conduct that violates these Terms, poses a security risk, or for any other reason at our discretion, including at the request of Georgetown University.

10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SHUTTLE TRACKING DATA WILL BE ACCURATE AT ALL TIMES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABE’S TRANSPORTATION, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR MISSED TRANSPORTATION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Abe’s Transportation, Inc. from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the App.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by other reasonable means. Continued use of HoyaLift after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the District of Columbia, without regard to its conflict-of-laws principles.
